1. Agreement to Terms

By accessing or using the website and services of BOOMY IT (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). 3. Payment Terms

Payment for services may be collected via secure third-party payment processors, including but not limited to Stripe and Payoneer. By choosing to pay through these providers, you also agree to their respective terms and privacy policies.

• Fees will be communicated before work begins. Unless otherwise agreed, payment may be required in full or in milestones (e.g., deposit and balance upon completion).
• Invoices are due within the period stated on the invoice (e.g., net 15 or net 30). Late payments may incur interest or suspension of services.
• All amounts are in the currency specified on the invoice. You are responsible for any taxes, bank fees, or conversion fees unless otherwise stated.

4. Client Obligations

You agree to provide accurate information, timely feedback, content, and access (e.g., to accounts or systems) necessary for us to perform the services. Delays caused by missing information or access may affect timelines. You are responsible for ensuring that any content or materials you provide do not infringe third-party rights or violate any law.

5. Intellectual Property

Unless otherwise agreed in writing, upon full payment for the relevant work, ownership of custom deliverables (e.g., code, designs) created specifically for you will transfer to you. We retain the right to use general skills, know-how, and pre-existing or generic components. Any third-party assets (e.g., fonts, stock media) may remain subject to their licenses.

6. Confidentiality

Each party agrees to keep confidential any non-public information received from the other in connection with the services. This obligation survives termination of the engagement. Exceptions apply where information is publicly available, independently developed, or required to be disclosed by law.

7. Limitation of Liability

To the fullest extent permitted by law, BOOMY IT’s total liability for any claims arising from or related to these Terms or the services shall not exceed the amount you paid to us for the specific project or service giving rise to the claim in the twelve (12) months prior to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, even if advised of their possibility.

8. Termination

Either party may terminate an engagement in accordance with the terms of the relevant project agreement. We may suspend or terminate access to our website or services for breach of these Terms or for any other reason with notice where practicable. Upon termination, your right to use our services ceases; payment obligations for work already performed remain.

9. General

These Terms constitute the entire agreement between you and BOOMY IT regarding the use of our website and general service terms, unless a separate signed agreement applies. We may update these Terms from time to time; the “Last updated” date will be revised, and continued use of our website or services after changes constitutes acceptance. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right.
